Know Your Rights When Dealing With Insurance

Washington law gives vehicle owners powerful protections. Most people simply aren’t told about them.

Your Right to Choose Your Repair Shop

Insurers cannot require you to use preferred shops or refuse reasonable repair estimates.

  • You have the right to choose where your vehicle is repaired. Your repair insurance company must make a good faith effort to honor your repair shop’s estimate or repair invoice and is prohibited from mandating consumers use preferred or “direct repair” shops or refusing to reasonably consider the repair facility’s estimate or final invoice.

  • Your insurer must pay the reasonable and necessary cost to repair your vehicle to its pre-condition.

Statute Citations

  • WAC 284.30.390 – Prohibits arbitrarily denying a claimant’s repair estimate.

  • WAC 284.30.330 – Requires insurers to attempt prompt, fair, and equitable settlements.

  • RCW 48.30.015 – Insurers must promptly provide a reasonable explanation of the basis in the insurance policy in relation to the facts or applicable law for a denial of its payment of benefits, including repair facilities repair estimate or invoice.

Why Written Communication Matters

  • Always communicate with the insurance company in writing and insist they respond in writing as well. Written communication creates a

    1. Clear record of what was said and promised

    2. Reduces misunderstandings or misstatements

    3. Protects you if disputes arise later

  • Email is acceptable and recommended. If you are unavailable for phone calls, you may request email-only communication. If it is not in writing, it cannot be reliably proven.

Appraisal Is a Legal Right in Washington

When you and the insurer disagree, appraisal is a binding, enforceable process under RCW 48.18.620.

  • Each party selects a competent and disinterested appraiser within 10 days.

  • Appraisers independently evaluate the actual cash value and amount of loss.

  • If the appraisers disagree, they select a neutral umpire.

  • An agreement by two of the three (either both appraisers or one appraiser and the umpire) is binding.

  • The appraisal process must be completed within 30 days.
